These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TicketBuddy AI ("ReviewBuddy," "we," "us," or "our") governing your access to and use of the ReviewBuddy platform, including our website (reviewbuddy.site), dashboard, API, and all related services (collectively, the "Service").

By creating an account, accessing our Service, or using any features, you represent that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws
• All information you provide is accurate and truthful

2. Description of Service

ReviewBuddy is an AI-powered platform that provides:

• Review Analysis: Automated collection and analysis of publicly available Trustpilot reviews
• Sentiment Analysis: AI-driven insights into customer sentiment and satisfaction
• Theme Extraction: Identification of key themes and topics from reviews
• Visual Reports: Charts, graphs, and downloadable PDF reports
• Q&A Feature: Interactive querying of your analyzed data
• Data Storage: Saved analysis results and history

The Service is provided on a credit-based system where each analysis consumes credits from your account balance.

3. Account Registration and Security

3.1 Account Creation

To use ReviewBuddy, you must create an account by providing:

• A valid email address
• A secure password (for email/password registration) OR
• Authorization to use Google OAuth for authentication

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

3.3 Account Security

• Choose a strong, unique password
• Do not share your account with others
• Log out after each session on shared devices
• We are not liable for losses caused by unauthorized use of your account

3.4 One Account Per User

You may only create one account per person. Creating multiple accounts to abuse free credits or promotional offers is strictly prohibited and may result in account termination.

4. Credits and Pricing

4.1 Credit System

• Free Credits: New users receive 25 free credits upon account creation
• Credit Usage: Each analysis consumes credits based on the number of reviews analyzed and features used
• Q&A Queries: Each question asked to the AI about your data consumes 1 credit
• Non-Refundable: Credits are non-refundable and non-transferable

4.2 Purchasing Credits

• Additional credits can be purchased through our credit packages
• Payments are processed securely via Stripe
• All prices are in USD unless otherwise stated
• We reserve the right to change pricing with 30 days' notice

4.3 Payment Terms

• Payment is due immediately upon purchase
• We accept major credit cards and payment methods supported by Stripe
• You authorize us to charge your payment method for purchases
• All sales are final unless otherwise required by law

4.4 Refund Policy

• Credit Purchases: Generally non-refundable
• Service Issues: Refunds may be issued at our discretion if technical issues prevent you from using purchased credits
• Refund Requests: Must be submitted within 14 days of purchase to info@ticketbuddy.ai
• Promotional Credits: Not eligible for refunds

5. Acceptable Use Policy

5.1 Permitted Use

You may use ReviewBuddy for:

• Analyzing publicly available Trustpilot reviews of businesses
• Generating insights for business intelligence and decision-making
• Creating reports and visualizations for internal business use
• Understanding customer sentiment and feedback

5.2 Prohibited Use

You may NOT:

• Violate Laws: Use the Service for illegal purposes or in violation of any laws
• Abuse the Service: Overload, hack, or attempt to gain unauthorized access to our systems
• Scrape or Automate: Use bots, scrapers, or automated tools without written permission
• Reverse Engineer: Attempt to reverse engineer, decompile, or extract our AI models or algorithms
• Resell: Resell, redistribute, or commercialize the Service or analysis results without authorization
• Manipulate: Create fake accounts, abuse free credits, or manipulate the credit system
• Harm Others: Use the Service to harass, defame, or harm individuals or businesses
• Compete: Use the Service to build a competing product or service
• Violate Privacy: Attempt to identify or contact individual reviewers beyond what is publicly available

5.3 Rate Limits

We may impose rate limits to ensure fair usage and system stability. Excessive use may result in temporary restrictions or account suspension.

6. Intellectual Property Rights

6.1 Our Intellectual Property

ReviewBuddy and all related content, features, and functionality are owned by TicketBuddy AI and are protected by international copyright, trademark, and other intellectual property laws.

This includes, but is not limited to:

• Software, code, and algorithms
• AI models and machine learning systems
• User interface, design, and graphics
• Logos, trademarks, and brand elements
• Documentation and educational materials

6.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

6.3 Your Content

• Ownership: You retain ownership of any content you submit (e.g., Trustpilot URLs, queries)
• License to Us: You grant us a license to use your submitted data to provide the Service
• Analysis Results: You own the reports and insights generated from your analyses

6.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation or compensation to you.

7. Third-Party Services and Content

7.1 Trustpilot Data

• ReviewBuddy collects publicly available data from Trustpilot
• We are not affiliated with or endorsed by Trustpilot
• Trustpilot's terms of service apply to their platform
• We make no representations about the accuracy of Trustpilot data

7.2 Third-Party Services

Our Service uses third-party providers (Azure, OpenAI, Stripe, etc.). Your use may be subject to their terms:

• Microsoft Azure Terms
• OpenAI Terms of Use
• Stripe Terms of Service
• Google OAuth Terms (if using Google sign-in)

7.3 Third-Party Links

Our Service may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites.

8. AI and Data Accuracy

8.1 No Guarantees

• AI analysis may contain errors, inaccuracies, or biases
• Sentiment scores are estimates, not facts
• Theme extraction may miss or misclassify topics
• Q&A responses may be incomplete or incorrect

8.2 Your Responsibility

• Verify AI-generated insights before making business decisions
• Do not rely solely on ReviewBuddy for critical business decisions
• Use professional judgment and consult experts when necessary

8.3 Data Freshness

• Analysis reflects publicly available data at the time of collection
• Reviews on Trustpilot may change after analysis
• We do not guarantee real-time or up-to-date data

9. Service Availability and Modifications

9.1 Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance may cause temporary unavailability
• We are not liable for downtime, delays, or service interruptions

9.2 Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue any feature at any time
• Change credit pricing or consumption rates with notice
• Update AI models and algorithms
• Limit features to certain user tiers

9.3 Updates to Terms

• We may update these Terms from time to time
• Material changes will be notified via email or dashboard notification
• Continued use after changes constitutes acceptance
• If you do not agree to changes, you must stop using the Service

10. User Data and Privacy

Your use of ReviewBuddy is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

10.1 Data Retention

• Analysis results are stored for 12 months or until deletion
• You can delete your data at any time from your dashboard
• Account deletion removes all associated data within 90 days

10.2 Data Security

• However, no system is 100% secure
• You assume risk for data transmitted over the internet

11. Disclaimers and Limitation of Liability

11.1 "AS IS" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of AI analysis
• Uninterrupted, secure, or error-free operation
• Absence of viruses or harmful components

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIEWBUDDY AND TICKETBUDDY AI SHALL NOT BE LIABLE FOR:

• Indirect Damages: Lost profits, revenue, data, or business opportunities
• Consequential Damages: Damages arising from business decisions based on our Service
• Incidental Damages: Costs of procuring substitute services
• Special or Punitive Damages

Maximum Liability: Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months before the claim, or $100 USD, whichever is greater.

11.3 Exceptions

Some jurisdictions do not allow limitation of implied warranties or liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless TicketBuddy AI, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of any third-party rights (including Trustpilot's terms)
• Your violation of any applicable laws or regulations
• Content you submit or actions you take using the Service

13. Termination

13.1 Termination by You

• You may close your account at any time from your dashboard settings
• Unused credits are forfeited upon account closure
• No refunds for unused credits or partial billing periods

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activity
• Your account is inactive for more than 24 months
• We discontinue the Service
• Required by law or legal process

13.3 Effect of Termination

• Your license to use the Service ends immediately
• You must cease all use of the Service
• We may delete your data after 90 days
• Sections 6, 10, 11, 12, 14, and 15 survive termination

14. Dispute Resolution

14.1 Informal Resolution

Before filing any legal claim, you agree to first contact us at info@ticketbuddy.ai to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 30 days.

14.2 Arbitration Agreement

If informal resolution fails, you agree that any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except:

• Small claims court claims (under $10,000)
• Intellectual property disputes
• Claims for injunctive relief

14.3 Class Action Waiver

YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

You may not use the Service if you are located in a country embargoed by the United States or if you are on any U.S. government list of prohibited parties.
